01 /Why dispensaries are different

No ad budget buys
your way in.

Most local businesses can pay Google to sit above the map. A New York dispensary can’t, so being found organically is the whole game.

Google Ads: not allowed.

Google’s recreational drugs policy bars ads for substances that induce highs and names marijuana as an example. It also bars ads for services that facilitate drug use, with “cannabis coffee shops” listed. The exceptions are narrow: approved topical hemp CBD in California, Colorado and Puerto Rico, and a Search-only pilot in Canada through 2026.

Facebook and Instagram ads: not allowed.

Meta’s advertising standards say advertisers can’t run ads that promote THC products or cannabis products with related psychoactive components. That covers what a dispensary sells. CBD ads need separate certification, and a menu of THC products doesn’t qualify.

Your Google profile: allowed, with limits.

A dispensary with a storefront can have a Business Profile, but Google won’t accept cannabis businesses as service-area businesses without one. Posts can’t include content about the products, Maps content can’t show deals or pricing for regulated goods, and Google says it may suspend profiles that don’t follow its guidelines.

So the map pack, your own website and the AI answers people now read before they drive anywhere are where a dispensary wins or loses. A suspended profile isn’t a setback, it’s the storefront going dark. What to do if yours is suspended ↗

What OCM’s rules mean
for your site and socials.

Adult-use marketing in New York falls under Part 129 of the Office of Cannabis Management’s regulations, revised and filed in December 2025. These are the parts that touch digital marketing.

Topic What the rule says
Audience age You may only advertise where the share of the audience age 21 and older is expected to meet or exceed the state’s own 21+ share, from the latest Census estimates. OCM’s guidance puts that at 75.9% today. The burden of proof is on the licensee, and you must keep records. Ads seen only inside your store are exempt. (§129.2(g), (h))
Your website A licensee that advertises through a website or app needs a mechanism requiring visitors to verify they are 21 or older. Unsolicited pop-ups and banners are out, except on age-restricted sites where visitors 21+ have consented. (§129.2(l), (b)(25))
Required warnings Visual ads carry the statement “For use only by persons 21 years of age and older. Keep out of reach of children and pets. If someone accidentally consumes cannabis, contact the Poison Center. Consume responsibly.” and a rotating health warning, both in a bright yellow box, plus the NYS HOPEline and your name and license number. (§129.2(c)–(f), (k))
Social media Your profile page must say cannabis is legal only for people 21 and older and show your license number. Social ads go only to users who verify they are 21+. (§129.2(m), (n))
Appeal to minors Nothing attractive to people under 21: no cartoons or mascots, nothing imitating candy, soda or cereal, and no models who could look under 21 unless they are at least 25. (§128.1(c), §129.2(b))
Claims No false or misleading content, no medical or wellness claims, no promoting potency or overconsumption, no showing consumption, and no saying products are safe because they are regulated. (§129.2(b))
Deals and giveaways Discounts, coupons and loyalty programs are allowed if prices stay at or above market value (OCM uses 1.5× wholesale) and tax is charged on the pre-discount price. Outside the store, offers can run only by electronic message, mailer, your website or a third-party site meant for adults 21 and older. Giveaways of cannabis products are out, and OCM’s guidance says ads can’t use the words “free” or “donated.” (§129.3)

Some online copies of these rules still show an older 90% audience threshold. The rules OCM adopted in December 2025 replaced it with the Census-based share above. Can dispensaries run Google Ads?

Not in the US. Google’s recreational drugs policy does not allow ads for substances that induce highs, and it lists marijuana as an example. The only exceptions are approved ads for topical hemp-derived CBD in California, Colorado and Puerto Rico, and a Search-only pilot for licensed cannabis businesses in Canada that runs through the end of 2026.

Can a dispensary have a Google Business Profile?

Yes, if it has a storefront customers can visit. Google says businesses selling age-restricted products like cannabis aren’t permitted as service-area businesses without a storefront, so a delivery-only operation can’t list that way. Posts are allowed for regulated businesses as long as they don’t include content about the products.

What are New York’s rules for dispensary advertising?

They are in Part 129 of the Office of Cannabis Management’s regulations, last revised in December 2025. Ads must reach an audience at least as adult as the state as a whole (75.9% age 21 or older, per OCM’s current figure) and carry set warnings, the NYS HOPEline and your license number. How long until we show up in the map pack?

It depends on where you start, how many dispensaries compete near you and whether your profile is in good standing. In our case study, the store’s Google profile came back in March, and by the August 18 scan it was in the top 3 at 20 of 24 map grid points. We won’t promise a date, but we track the grid so you can watch it move.

Do you work with dispensaries outside Long Island?

Yes. We’re based in Westhampton Beach and work with licensed dispensaries across New York State. The OCM rules are statewide and map rankings are local to each store, so we plan the work around your trade area wherever it is.

Will your work get our Google profile suspended?

Nobody can promise Google will never act on a profile, and an agency that says otherwise is guessing. What we can promise is that we follow Google’s guidelines: your real business name, a real storefront, no product content in posts and no fake reviews. If a profile is suspended anyway, we handle the appeal.
